Terms of Service

1. Agreement to Terms

By downloading, installing, or using NordHUD ("the App"), you agree to be bound by these Terms of Service ("Terms"). The App is provided by MapTube AB, a company registered in Sweden ("we", "our", or "us"). If you do not agree to these Terms, do not use the App.

2. Important Safety Disclaimer

NordHUD is a driver assistance tool only. It does not replace your responsibility as a driver.

  • Speed limit information displayed is for reference only and may not always be accurate or current
  • Always observe actual road signs and comply with local traffic laws and regulations
  • The driver is solely responsible for safe operation of the vehicle at all times
  • Do not interact with the App while driving - set up before you start driving
  • Speed limit data is based on OpenStreetMap and may contain errors or be outdated
  • We do not guarantee the accuracy, completeness, or timeliness of speed limit information

You acknowledge that relying solely on the App for speed limit information is at your own risk.

3. Service Description

NordHUD provides:

  • A heads-up display showing your current speed
  • Speed limit information based on your GPS location (where available)
  • Offline functionality using downloaded map data
  • Optional OBD-II device connectivity for enhanced speed accuracy (Pro version)

4. License and Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You agree not to:

  • Copy, modify, or distribute the App or its content
  • Reverse engineer, decompile, or disassemble the App
  • Remove any copyright or proprietary notices
  • Use the App for any illegal purpose or in violation of traffic laws
  • Use the App in any way that could damage or impair the service
  • Resell, sublicense, or commercially exploit the App without our written consent

5. Purchases and Subscriptions

In-App Purchases: The App may offer additional features, map packs, or premium functionality through in-app purchases. All purchases are processed through Apple's App Store.

Pro Version: The Pro version may be activated through in-app purchase or by purchasing a hardware bundle with a QR activation code.

Refunds: All purchases are subject to Apple's refund policy. We do not directly process refunds. To request a refund, please contact Apple Support or use the "Report a Problem" feature in your purchase history.

Price Changes: We reserve the right to change prices at any time. Price changes will not affect purchases already made.

5.5. Data Access & Usage

What You Get:

  • Access to download map packs you've purchased
  • Unlimited downloads per map pack (for device changes, updates, re-downloads)
  • Personal, non-commercial use of the app and data

Usage Limits:

  • Maximum 10 map downloads per hour
  • Maximum 30 map downloads per day
  • No simultaneous downloads
  • Map pack updates count as downloads
  • We reserve the right to throttle or temporarily restrict access if unusual usage patterns are detected

What You Can't Do:

  • Share your account credentials
  • Distribute downloaded map files to others
  • Use automated tools to mass-download maps
  • Create competing products using our service
  • Reverse engineer the mobile application

Fair Use:

We monitor download patterns. Accounts showing signs of abuse (unusual download volumes, suspicious patterns, credential sharing) will be investigated and may be suspended.

Normal usage (downloading your purchased maps, re-downloading after device change, or updating to newer map versions) is always permitted. Note that map pack updates count toward your download limits.

Open Data Acknowledgment:

Map data is derived from OpenStreetMap (© OpenStreetMap contributors) under the ODbL license. By using NordHUD, you agree to respect the ODbL terms when handling this data.

Enforcement:

Violation of these terms may result in:

  1. Warning and temporary rate limiting
  2. Temporary account suspension
  3. Permanent account termination (with potential refund)
  4. Legal action (for commercial abuse or redistribution)

6. Hardware Bundle Terms

If you purchase a hardware bundle (OBD-II reader with Pro activation):

  • QR activation codes are single-use and non-transferable once activated to an account
  • Hardware is covered by a limited warranty as specified at time of purchase
  • We are not responsible for any damage caused by improper use of OBD-II devices
  • Compatibility with all vehicles is not guaranteed - check your vehicle's OBD-II port compatibility

7. Map Data

Speed limit data is derived from OpenStreetMap, a collaborative open-source project. Map data is provided "as is" and may contain inaccuracies.

  • Map data is downloaded for offline use and stored on your device
  • We may update map data periodically but do not guarantee update frequency
  • Coverage and accuracy vary by region - some areas may have limited or no data
  • Where explicit speed limits are not available, the App may display inferred limits based on road classification

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The App is provided "AS IS" without warranties of any kind, either express or implied
  • We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement
  • We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages
  • We are not liable for any traffic violations, fines, penalties, accidents, or injuries that may occur while using the App
  • Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless MapTube AB and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App, violation of these Terms, or infringement of any rights of another party.

10. Intellectual Property

The App, including its design, features, and content (excluding map data from OpenStreetMap), is owned by MapTube AB and protected by copyright and other intellectual property laws. OpenStreetMap data is used under the Open Database License (ODbL).

11. Changes to the Service

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms in the App or on our website. Your continued use of the App after changes constitutes acceptance of the modified Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately. Provisions that by their nature should survive termination shall survive.

14. Governing Law and Disputes

These Terms shall be governed by the laws of Sweden, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Gothenburg, Sweden. For consumers within the EU, this does not affect your statutory rights under applicable consumer protection laws.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
